This Global Privacy Policy describes the types of personal information and other information NutraMedix (“NutraMedix,” the “Company,” “We” or “Our”) may collect from you or that you may provide when you visit the website or mobile app (each, a “Service” and together “Services”) where this Global Privacy Policy is posted and our practices for collecting, using, maintaining, protecting, and disclosing that information. This Global Privacy Policy is intended to notify you of our online privacy practices, the types of information that may be collected and stored, how information may be used and shared, what choices are available to you regarding the collection, use and distribution of information, what kind of security procedures are in place to protect the loss, misuse or alteration of information under our control, and who to contact with questions or concerns. 

Please read this Global Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Services. This Global Privacy Policy may be updated from time to time. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check periodically for updates. 2.     Relevant NutraMedix entity

NutraMedix LLC is responsible for the setting of NutraMedix’s global positioning, also regarding data protection issues.

If you are in the European Economic Area or the United Kingdom, the local relevant entity for any questions you may have is NutraMedix (Ireland) Limited, with registered address at Carlton House-4th Floor, Henry Street, Co. Limerick, Limerick V94 FD80, Ireland.

3.     Children Under the Age of 16

Our Services are not intended for children under 16 years of age, and we do not knowingly collect personal information from children under 16. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. We collect information for the following purposes:

Types of Cookies Utilized

·     Strictly necessary cookies. These are cookies which are strictly necessary for us to provide the Services. For example, these types of cookies provide the necessary security that your visit to the Services requires, help ensuring the content of the pages you request load quickly and remember which products you wish to buy when you put them in your ‘Shopping Cart’. Without these cookies, some of the services that you have asked for cannot be provided.

·     Performance cookies. These cookies collect anonymous information about the web pages you visit. We use these cookies to collect information about how visitors use the Services. For example, which pages our visitors go to most often, and if they get error messages on those pages. We may also use your information to contact you about goods and services and provide news and other information that may be of interest to you. If you do not want us to use your information in this way, please adjust your user preferences in your account profile or unsubscribe using the link provided in an email message. Note, however, that if you opt-out of commercial email messages you will continue to receive messages that we are entitled to send.

Use of Web Beacons, Clear GIFs, Pixel Tags and JavaScript:

We also may use web beacons (also called “Internet tags,” “pixel tags,” or “clear GIFs”) and/or JavaScript plug-ins, placed on our website and in our emails to you. These web beacons and plug-ins are small graphic images (typically that you cannot see) or code on a website or in an email message that are used to transmit information to web servers, for example, to record web pages and advertisements clicked on by a user, or to track the performance of email marketing campaigns. These files may help us analyze our users’ online behavior and measure the effectiveness of our website and our communications. We may also work with third-party service providers that help us track, collect, and analyze this information. Search Queries, Server Logs and Widgets:

A web “server log” is a record of activity created by a computer that delivers certain web pages to your browser. Certain activities that you perform on our website may record information in server logs, such as if you enter a search term into a search box located on the website. The server log may record, for example, the search terms or the link you clicked on to bring you to our website. The server log may also record information about your browser, such as your IP address and the cookies set on your browser and we may aggregate that information with other information we may have about the browser and/or IP address from which the search query originated.

A “widget” is generally an application that can be embedded in a webpage.  Widgets can provide real-time information to the webpage.  Widgets are often provided by third-parties; we may provide widgets on our website. Widgets may enable the third-parties that provide them to collect data about users visiting the website.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may also disclose personal information that we collect or you provide as described in this Global Privacy Policy:

·     To fulfill the purpose for which you provide it.

9.     Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

·     Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

·     Promotional Offers from the Company. If you do not wish to have your contact information used by the Company to promote our own or third-parties’ products or services, you can opt out by pressing the unsubscribe link at the bottom of our emails or by sending us an email stating your request to privacy@nutramedix.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience, or other transactions.

As described above, we may work with third parties that use cookies and other technologies to collect information about your use of our Services and serve online ads likely to be of interest to you. To learn more about interest-based advertising or to opt-out of having your web browsing information used for interest-based advertising, visit the Digital Advertising Alliance (“DAA”) website. Note, however, that not all providers participate. 11.  Accessing and Correcting Your Information

You can review and change your personal information by logging into the Services and visiting your account profile page.

You may also send us an email at privacy@nutramedix.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Services that are California residents to request, once during any calendar year, a list of categories of personal information disclosed to third parties during the immediately preceding calendar year for such parties’ own direct marketing purposes, and a list of third parties to whom we disclosed such information.

Legal Bases for Processing

 

The GDPR and UK GDPR require that we inform you of the legal bases we rely on to process your personal information. The legal bases for processing are set forth below.

 

●       Our legitimate interests. For example, to perform a contract with the business you represent (see below for consumers), maintain system security, communicate with you, process orders and payments and fulfill your requests, respond to your inquiries, conduct surveys, administer and improve our products and services, and protect your rights, our rights and our business and the rights of others.

 

●       Contract. To perform a contract with you if you are a consumer (see “legitimate interests” above for businesses).

Location of processing

 

As NutraMedix is based in the United States, by using our services you acknowledge that your personal information will be processed in the United States. In addition, we may share personal information with service providers and third parties located outside of the EEA and United Kingdom.

 

Data Retention

 

We will keep your personal information in a form that permits us to identify you as a data subject for no longer than necessary for the purposes for which the personal information was gathered, and in all cases no longer than until you withdraw your consent (if consent is the legal basis for processing of data) or object to processing your data (if you have such a right and we cannot demonstrate compelling legitimate grounds to keep processing your personal information).

 

Your rights

 

You have the right to (with some exceptions):

 

●      Request access to your personal information (including to obtain confirmation as to whether or not your personal information is being processed, obtain additional details about the data being processed, and obtain a copy of such personal information);

●      Request correction of your personal information;

●      Request erasure of your personal information;

●      Object to processing of your personal information; and

●      Request to restrict processing of your personal information.

You can exercise these rights by sending an email to privacy@nutramedix.com with a description of your request. We will endeavor to fulfill your request to exercise these rights, but we may have legal grounds or obligations to reject your request. We will respond within one month after we have verified that you are the data subject or are authorized to make the request on behalf of the data subject. If necessary, we may extend our response time by an additional two months to respond properly, but we will notify you if that is the case within one month.

 

If we decide not to fulfill your request, we will tell you the reasons why. If you disagree with our response to your request, you have the right to lodge a complaint with a data protection regulator in the EEA (if you are a resident of the EEA) or Information Commission (if you are a resident of the United Kingdom). Should you have any concerns, we request that you contact us first so we can investigate, and hopefully resolve, your concerns.
